الشروط والأحكام

مقدمة

مرحبًا بك في أموري ("أموري"، "نحن"، "لنا"). تحكم هذه الشروط والأحكام ("الشروط") استخدامك لتطبيق وموقع أموري لتوصيل البقالة ("الخدمة"). من خلال الوصول إلى الخدمة أو استخدامها، فإنك توافق على الالتزام بهذه الشروط. إذا كنت لا توافق عليها، يرجى عدم استخدام الخدمة.

الأهلية لاستخدام الخدمة

يجب أن يكون عمرك 18 عامًا فأكثر لاستخدام خدماتنا، وأن تكون قادرًا على تكوين عقد ملزم قانونًا. باستخدامك للخدمة، فإنك تؤكد استيفاءك لهذا الشرط.

الحسابات وتسجيل الدخول

للوصول إلى بعض ميزات الخدمة، يتعين عليك تسجيل الدخول برقم هاتفك والتحقق منه عبر رمز OTP. أنت مسؤول عن الحفاظ على سرية بيانات حسابك وعن جميع الأنشطة التي تتم من خلاله. يرجى إخبارنا فورًا في حال الاشتباه بأي استخدام غير مصرح به لحسابك.

الطلبات والتسعير

جميع الطلبات المقدمة عبر التطبيق تخضع لتوفر المنتجات. نسعى لعرض أسعار ومعلومات دقيقة عن المنتجات، لكننا لا نضمن خلوها التام من الأخطاء، ونحتفظ بالحق في تصحيح أي خطأ في التسعير أو التوفر حتى بعد تأكيد الطلب.

الدفع والتوصيل

تُقدَّر أوقات التوصيل ولا تُعد مواعيد مضمونة، وقد تتأثر بعوامل خارجة عن إرادتنا مثل الطقس أو الازدحام أو توفر الفرع.

الإلغاء والاسترجاع

يمكنك إلغاء الطلب قبل بدء تجهيزه من خلال التطبيق أو بالتواصل معنا مباشرة. بعد التوصيل، تُعالَج طلبات الاسترجاع أو الاستبدال حسب حالة المنتج وسياسة الفرع المعني، وسيتم التواصل معك لحل أي مشكلة تتعلق بجودة المنتجات المستلمة.

سلوك المستخدم

عند استخدامك للخدمة، فإنك توافق على عدم:

• تقديم معلومات كاذبة أو مضللة عند إنشاء الحساب أو الطلب.
• استخدام الخدمة لأي غرض غير قانوني أو ضار.
• محاولة الوصول غير المصرح به إلى أنظمتنا أو حسابات مستخدمين آخرين.
• إعادة بيع المنتجات المطلوبة عبر الخدمة لأغراض تجارية دون إذن منا.

الملكية الفكرية

جميع العناصر الظاهرة في التطبيق والموقع، بما فيها الشعار والتصميم والنصوص والرسومات، مملوكة لأموري أو مرخصة لها، ولا يجوز استخدامها أو نسخها دون إذن كتابي مسبق.

حدود المسؤولية

تُقدَّم الخدمة "كما هي"، ولا نضمن أنها ستكون خالية من الأخطاء أو الانقطاع بشكل دائم. لا تتحمل أموري المسؤولية عن أي أضرار غير مباشرة أو عرضية تنشأ عن استخدامك للخدمة، إلى أقصى حد يسمح به القانون.

التعويض

توافق على إبراء ذمة أموري ومديريها وموظفيها من أي مطالبات أو أضرار أو نفقات ناتجة عن مخالفتك لهذه الشروط أو استخدامك غير السليم للخدمة.

إنهاء الخدمة

يجوز لنا تعليق أو إنهاء وصولك إلى الخدمة في حال مخالفتك لهذه الشروط، دون إشعار مسبق، وذلك لحماية سلامة الخدمة ومستخدميها الآخرين.

التغييرات على الشروط

قد نقوم بتحديث هذه الشروط من وقت لآخر. سيتم نشر أي تغييرات على هذه الصفحة مع تحديث تاريخ السريان، واستمرارك في استخدام الخدمة بعد النشر يُعد موافقة على الشروط المحدثة.

القانون الحاكم

تخضع هذه الشروط وتُفسَّر وفقًا لقوانين جمهورية العراق، وتؤول الاختصاص القضائي للمحاكم العراقية المختصة.

Introduction

Welcome to Amory ("Amory," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your use of the Amory grocery delivery app and website (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Eligibility

You must be at least 18 years old to use our Service and capable of forming a legally binding contract. By using the Service, you confirm that you meet this requirement.

Accounts & Sign-In

To access certain features of the Service, you must sign in with your phone number and verify it via OTP. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Please notify us immediately if you suspect any unauthorized use of your account.

Orders & Pricing

All orders placed through the app are subject to product availability. We strive to display accurate pricing and product information, but we do not guarantee it will be entirely free of errors, and we reserve the right to correct any pricing or availability error even after an order has been confirmed.

Payment & Delivery

Delivery times are estimates, not guaranteed windows, and may be affected by factors beyond our control such as weather, traffic, or branch availability.

Cancellations & Returns

You may cancel an order before it enters preparation through the app or by contacting us directly. After delivery, return or replacement requests are handled based on the condition of the product and the relevant branch's policy, and we will reach out to resolve any issue regarding the quality of products received.

User Conduct

When using the Service, you agree not to:

• Provide false or misleading information when creating an account or placing an order.
• Use the Service for any unlawful or harmful purpose.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Resell products ordered through the Service for commercial purposes without our permission.

Intellectual Property

All content appearing in the app and website, including the logo, design, text, and graphics, is owned by or licensed to Amory, and may not be used or copied without our prior written consent.

Limitation of Liability

The Service is provided "as is," and we do not guarantee it will be error-free or uninterrupted at all times. Amory shall not be liable for any indirect or incidental damages arising from your use of the Service, to the fullest extent permitted by law.

Indemnification

You agree to hold Amory and its directors and employees harmless from any claims, damages, or expenses arising from your violation of these Terms or improper use of the Service.

Termination

We may suspend or terminate your access to the Service if you violate these Terms, without prior notice, in order to protect the integrity of the Service and its other users.

Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page along with an updated effective date, and your continued use of the Service after such changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Iraq, and the competent Iraqi courts shall have exclusive jurisdiction.
